11. Digital Marketing and SEO

Digital marketing, advertising and SEO services involve factors outside our complete control.

We do not guarantee:

• A specific number of leads
• A specific amount of sales
• A particular advertising return
• Specific search-engine rankings
• A specific number of followers
• Guaranteed engagement
• Guaranteed revenue

Results may be affected by market conditions, competition, advertising platforms, search engines, client offerings, pricing, customer behaviour and other external factors.

12. Intellectual Property

Unless otherwise agreed in writing, Billian World retains ownership of its pre-existing materials, methods, processes, templates, frameworks, tools, code libraries and other intellectual property used in providing services.

Upon full payment of the applicable project fees, ownership or usage rights in the final deliverables will transfer to the client to the extent specified in the applicable agreement.

Third-party materials remain subject to their respective licences and terms.

13. Client Materials

The client confirms that they have the necessary rights, permissions and licences to provide materials to Billian World for use in a project.

The client is responsible for ensuring that supplied:

• Images
• Videos
• Text
• Logos
• Fonts
• Software
• Data
• Other materials

do not infringe the rights of third parties.

The client agrees to indemnify Billian World against claims arising directly from materials supplied by the client where permitted by applicable law.

14. Portfolio and Promotional Use

Unless otherwise agreed in writing, Billian World may display completed work in its portfolio, website, social media, presentations and other promotional materials for the purpose of demonstrating our work.

If a project contains confidential information or the client requires the work to remain private, this should be agreed in writing before or during the project.

15. Confidentiality

We will take reasonable steps to keep confidential information provided by clients confidential.

Clients are also expected to keep confidential information received from Billian World confidential.

Specific confidentiality requirements may be covered by a separate Non-Disclosure Agreement or contract.

16. Third-Party Services

Some projects may depend on third-party services, including:

Unless ongoing maintenance is expressly included in a service agreement, completion of a website, application or digital system does not automatically include unlimited future maintenance or support.

Maintenance, updates, security monitoring, content updates and technical support may be provided under a separate agreement or support package.

18. Cancellation and Termination

Either party may terminate a project or service agreement in accordance with the terms of the applicable agreement.

If a client cancels a project after work has commenced, the client may be responsible for payment for work already completed, committed costs and other non-refundable expenses.

Any refund will be determined according to the applicable agreement and applicable law.

19. Refunds

Refund arrangements will depend on the nature of the service and the terms agreed with the client.

Because creative, development and consulting services may involve work being performed specifically for a client, payments relating to completed work, committed third-party costs or non-refundable services may not be refundable.

Specific refund terms should be stated in the relevant quotation or service agreement.

20. Disclaimer

To the fullest extent permitted by applicable law, Billian World does not guarantee that:

• The website will always be available
• The website will be completely error-free
• All information will always be current
• Third-party services will always operate without interruption
• Digital marketing or SEO services will produce a particular commercial result

We will, however, use reasonable professional care in delivering services agreed with our clients.

21. Limitation of Liability
